CHALLENGES OF NORMATIVE AND LEGAL SUPPORT FOR PHYSICAL EDUCATION OF GENERAL SECONDARY EDUCATION STUDENTS IN THE CONTEXT OF THE NEW UKRAINIAN SCHOOL

In the contemporary context of reforming general secondary education, regulatory and legal frameworks acquire particular significance, serving both as a roadmap for transformation within the New Ukrainian School and as a codified set of guidelines for all stakeholders in the educational process. However, the implementation of the New Ukrainian School’s conceptual foundations into pedagogical practice reveals a range of challenges related to the existing regulatory and legal provisions that govern the reform of education. This article addresses the problem of ensuring that the conceptual foundations of the New Ukrainian School are adequately supported by a coherent legal and regulatory base, particularly with regard to their effective implementation in the domain of physical education. Through an analysis and synthesis of relevant normative legal acts, comparison of their regulatory provisions, comparative legal analysis of documents, and a systematic examination of the connections between the School’s key concepts and specific legal norms, several challenges in the regulatory and legal support for physical education in general secondary institutions have been identified. These challenges include inconsistencies in certain provisions of the legal framework underpinning the New Ukrainian School, contradictions in the goal-setting processes within the educational field of "Physical Culture," insufficient legal support for implementing the principle of academic freedom, and the underdevelopment of competency-based content in physical education curricula. To address these issues, it is necessary to harmonize conflicting statements across various legal and regulatory documents governing physical education in schools; to align the normative provisions of the "Physical Culture" domain with the foundational principles of the New Ukrainian School; to develop regulatory instruments that support the implementation of its conceptual provisions; and to refine and clarify existing legal regulations in order to achieve meaningful progress in the ongoing reform of school education.
